This Privacy Policy applies to Tempo’s website, mobile application, web portal, client portal, professional/applicant portal, SMS/MMS text messaging, phone communications, email communications, chat and support tools, interview scheduling, onboarding, payroll and employment administration, credentialing, and related staffing services.

This Privacy Policy does not apply to third-party websites, third-party services, or client dental practice systems that Tempo does not control. Client dental practices remain responsible for their own patient privacy, HIPAA, clinical, workplace, and employment compliance obligations.

2. Information We Collect

We may collect the following categories of information depending on how you interact with Tempo:

  • Contact and account information: name, email address, phone number, mailing address, business address, username, password, role, preferences, login activity, and account settings.
  • Professional and application information: resume, work history, education, availability, experience, skills, licenses, certifications, credential documents, references, profile photo, professional summary, employment preferences, and onboarding information.
  • Employment, payroll, and tax information: information needed for W-2 employment, payroll, wage reporting, tax withholding, work authorization, I-9 administration, time records, assignment records, and related employment records.
  • Screening and verification information: background check authorization status, background screening results where permitted by law, public records search information, license verification, credentialing information, and reference check information.
  • Client and practice information: practice name, business contacts, practice address, assignment locations, staffing needs, shift requests, requested qualifications, billing contacts, payment status, and client preferences.
  • Payment and billing information: payment method details submitted through a payment processor, transaction references, invoices, billing history, account balances, and payment status. Tempo does not store full card numbers when payments are processed by a third-party payment processor.
  • Communications: emails, SMS/MMS messages, phone calls, voicemails, chat messages, portal messages, support requests, interview scheduling information, and related communication history.
  • Device, usage, location, and security information: IP address, browser type, device type, operating system, device identifiers, user or account ID, pages or features used, product interaction, timestamps, authentication logs, crash data, diagnostics, error reports, approximate or precise device location when enabled through the app, device settings, or platform functionality, and similar information used to operate, secure, troubleshoot, personalize, and improve the services.
  • Consent and acceptance records: records showing acceptance of policies, terms, electronic signatures, SMS opt-in, version accepted, timestamps, IP address, and browser or device information associated with consent.

3. How We Use Information

  • Create, authenticate, maintain, and secure accounts.
  • Review applications and coordinate recruiting, interviews, credentialing, onboarding, assignments, and staffing opportunities.
  • Provide W-2 employment administration, payroll, tax, timekeeping, work authorization, workers' compensation, insurance, and related recordkeeping.
  • Coordinate client staffing requests, shift confirmations, schedule changes, cancellations, billing, and account support.
  • Communicate by email, phone, voicemail, SMS/MMS, push notification, chat, app, web portal, and other service-related channels.
  • Personalize the user experience, including displaying user names, role-specific content, profile details, preferences, relevant opportunities, app settings, and other information tailored to the user's account or activity.
  • Process payments, maintain billing records, collect amounts owed, and administer payment methods on file.
  • Conduct background screening, public records searches, credential verification, reference checks, and compliance reviews where permitted and with required authorization when applicable.
  • Operate, secure, troubleshoot, analyze, and improve the website, app, web portal, staffing platform, and related services.
  • Prevent fraud, misuse, unauthorized access, unsafe activity, policy violations, or unlawful activity.
  • Comply with legal, tax, employment, payroll, insurance, credentialing, safety, recordkeeping, and dispute-resolution obligations.

4. W-2 Employment and Application Records

Tempo is a Texas W-2 staffing company. Temporary dental professionals who are hired and assigned through Tempo are W-2 employees of Tempo unless otherwise stated in a separate written agreement. Tempo may collect and retain employment, payroll, tax, credentialing, onboarding, assignment, timekeeping, safety, insurance, and compliance records as needed to administer employment and staffing services.

Submitting an application, creating an account, completing onboarding, or accepting electronic communications does not guarantee employment, an interview, an assignment, or continued assignment opportunities.

5. SMS/Text Messaging and Mobile Consent

Tempo may send SMS/MMS text messages to applicants, professionals, client dental offices, and other users for staffing and service-related purposes. Messages may include application updates, interview scheduling, onboarding reminders, credentialing reminders, shift opportunities, booking confirmations, schedule changes, cancellations, staffing request updates, account notices, billing or payment notices, and support messages.

SMS Opt-In Method.

Tempo uses a web form opt-in method to collect SMS/MMS consent. Users opt in by providing a valid mobile telephone number and affirmatively checking the SMS consent box, or otherwise affirmatively accepting the SMS consent disclosure, on an electronic form such as a website contact form, mobile application registration form, web portal registration form, professional application form, client inquiry form, staffing request form, interview booking form, onboarding form, or other online form that includes Tempo's SMS consent disclosure. Providing a phone number alone does not create SMS consent.

Message frequency varies based on your account activity, staffing needs, requests, onboarding status, assignments, and communications with Tempo. Message and data rates may apply.

  • Client dental practices: We may share professional profile information, credentials, work history, availability, assignment-related information, and other relevant staffing information with client dental practices to evaluate, coordinate, and secure staffing opportunities.
  • Professionals and applicants: We may share relevant client information, assignment location, schedule, position requirements, office expectations, and contact information needed to coordinate staffing services.
  • Legal and compliance disclosures: We may disclose information when required or permitted by law, subpoena, court order, regulatory request, legal process, insurance need, safety issue, or to protect Tempo, users, clients, professionals, or the public.
  • Business transactions: If Tempo is involved in a merger, acquisition, financing, sale of assets, reorganization, or similar transaction, information may be transferred as part of that transaction, subject to appropriate protections where required.
  • With your consent or direction: We may share information when you request, authorize, or direct us to do so.

9. No Patient Information or PHI in Tempo Tools

Tempo's website, app, web portal, SMS, email, phone, chat, and support channels are for staffing-related communication only. Users should not submit patient names, patient records, treatment details, diagnoses, x-rays, medical histories, patient billing records, or other protected health information ("PHI") through Tempo's systems unless specifically authorized in writing and permitted by law.

Client dental practices are responsible for HIPAA, patient privacy, clinical documentation, patient care, and supervision obligations within their own offices and systems.

10. Data Retention and Account Deletion

Tempo retains information as long as reasonably necessary to provide services, administer accounts, manage applications, coordinate staffing, administer employment and payroll, comply with legal and tax obligations, maintain credentialing and screening records, resolve disputes, enforce agreements, protect safety and security, support insurance or workers' compensation matters, and meet recordkeeping requirements.

You may initiate account deletion through the app or portal where available, or by contacting info@tempodentalstaffing.com. If you request deletion, we will review and respond as required by applicable law. Some information may be retained where necessary or permitted for employment, payroll, tax, legal, safety, credentialing, insurance, dispute-resolution, fraud-prevention, compliance, or legitimate business purposes.

11. Security

Tempo uses reasonable administrative, technical, and physical safeguards designed to protect personal information, including access controls, secure systems, encrypted transmission where available, vendor controls, and internal procedures. No method of transmission or storage is completely secure, and Tempo cannot guarantee absolute security.

12. Your Rights and Choices

Depending on your location and applicable law, you may have rights to request access to personal information, correction of inaccurate information, deletion of certain information, a copy of certain information, restriction or objection to certain processing, opt-out of certain marketing communications, or other rights. These Terms govern access to and use of Tempo Dental Staffing's mobile app, professional web portal, platform features, communications, and account services for dental professionals, applicants, Tempo employees, and other authorized professional users.

By creating an account, checking an acceptance box, submitting information, applying, accepting assignments, accessing the app or professional web portal, or otherwise using Tempo's platform, you agree to these Terms and acknowledge Tempo's Privacy Policy.

1Scope and Separate Employment Agreements

Professional users

Professionals, applicants, and Tempo employees may use the mobile app or professional web portal to create accounts, manage profiles, review opportunities, communicate with Tempo, and coordinate assignment activity.

Separate agreements

Your application, onboarding, employment, and assignment activity may also be governed by employment documents, handbook policies, onboarding materials, arbitration agreements, or other written terms. If one applies, it controls the subject matter it covers.

2Eligibility and Account Use

Eligibility and accuracy

You must be at least 18 and must provide accurate, current, and complete information.

Account security

You are responsible for keeping login credentials secure. Do not share credentials, allow unauthorized access, impersonate another person, or use another person's account. Notify Tempo promptly if you suspect unauthorized access or misuse.

3Privacy and Communications

Privacy Policy

Tempo's collection, use, sharing, retention, and protection of personal information is described in Tempo's Privacy Policy.

Electronic communications

Tempo may communicate by email, phone, voicemail, SMS/MMS, push notification, app message, portal message, chat, scheduling tool, or other electronic means for account, application, onboarding, credentialing, staffing, assignment, employment administration, payroll, support, and related business purposes. Professionals and applicants are responsible for keeping contact information current and monitoring Tempo communications.

4Staffing-Related Communication Only; No PHI

Tempo's platform and communication channels are for staffing-related communication only. Professionals and applicants should not submit patient names, patient records, treatment details, diagnoses, x-rays, medical histories, billing records, or other protected health information ("PHI") through Tempo's systems unless specifically authorized in writing and permitted by law.

Note: Dental professionals remain responsible for following applicable patient privacy requirements, HIPAA obligations, clinical documentation requirements, and the client practice's authorized privacy and security procedures while performing assignments.

5Professional and Applicant Terms

Application and profile information

By submitting an application, profile, credential, document, message, or other information, you represent that the information is true, accurate, current, and complete to the best of your knowledge.

No guarantee

Submitting an application, creating an account, completing onboarding, or accepting communications does not guarantee employment, an interview, an assignment, a particular schedule, a particular rate, continued opportunities, or placement with any client.

W-2 staffing model

Dental professionals hired and assigned through Tempo are W-2 employees of Tempo. Tempo administers payroll, wage reporting, tax withholding, employment documentation, and related W-2 employment administration for those employees.

Credentials and eligibility

Professionals are responsible for maintaining required licenses, certifications, credentials, availability, and accurate contact information. Assignments may be subject to credential review, reference checks, background screening authorization, work eligibility requirements, onboarding requirements, client requirements, and other eligibility requirements determined by Tempo or required by law.

Assignments and time records

A staffing opportunity is not guaranteed unless confirmed by Tempo through the app, portal, email, text, phone, or other communication method. Professionals are responsible for monitoring Tempo communications and submitting, confirming, and correcting time and assignment-related information according to Tempo's instructions and applicable policies.

Employment documents control employment matters

If you are hired by Tempo, your employment may also be governed by separate employment documents, onboarding materials, policies, handbook provisions, arbitration agreements, or other written terms. If these Terms conflict with a signed employment document or handbook policy, that document or policy controls the employment matter it covers.

6Platform Rules

Authorized use only

Use the platform only for lawful, authorized, staffing-related purposes.

Accurate and authorized information only

Do not provide false, misleading, incomplete, unauthorized, or impersonated information.

No system misuse

Do not access another account without authorization, share login credentials, bypass security controls, introduce harmful code, scrape data, interfere with the platform, reverse engineer systems, or misuse Tempo's technology or communications.

No competitive or unauthorized use

Do not copy, publish, forward, distribute, benchmark, or use Tempo's confidential client bill rates, nonpublic service terms, platform content, business materials, or staffing procedures for competitive, agency, recruiting, lead-generation, or other unauthorized purposes. Nothing in these Terms prohibits employees from discussing their own wages, hours, or working conditions or engaging in activity protected by applicable law.

No harmful conduct

Do not use the platform to harass, discriminate, threaten, abuse, mislead, defraud, or violate the rights of Tempo, clients, professionals, patients, or third parties.

7Tempo Content, Professional Submissions, and Third-Party Technology

Tempo content

Tempo's name, logo, app, portal, website, platform content, workflows, forms, copy, designs, trademarks, service marks, business materials, and related intellectual property are owned by Tempo or its licensors and may not be copied, modified, distributed, or used without written permission except as allowed through authorized platform use.

Professional submissions

By uploading or submitting content, documents, credentials, profile information, messages, photos, or other materials, you authorize Tempo to use, process, and share those materials as reasonably necessary to operate the platform, evaluate applications, coordinate staffing, administer employment, support staffing services, comply with law, and enforce agreements, subject to Tempo's Privacy Policy.

Third-party technology

Tempo may use third-party technology providers to operate, host, maintain, support, or improve the platform. Professional users may not access, copy, interfere with, reverse engineer, misuse, or attempt to bypass any part of the platform or related systems.

8Suspension, Availability, and Disclaimers

Suspension or removal

Tempo may suspend, restrict, remove, or terminate platform access if Tempo believes a professional user has violated these Terms, provided inaccurate information, created risk, misused the platform, or acted in a way that may harm Tempo, users, third parties, or the integrity of the platform.

Platform availability

The platform and related technology services are provided on an "as is" and "as available" basis. Tempo does not warrant that the platform will be uninterrupted, error-free, secure, or free of harmful components.

No guaranteed outcome

Tempo does not guarantee assignment availability, client demand, employment, continued employment, placement, or any specific staffing outcome.

9Limitation of Liability

To the fullest extent permitted by law, Tempo will not be liable for indirect, incidental, consequential, special, exemplary, punitive, lost-profit, lost-revenue, loss-of-business, loss-of-goodwill, data-loss, or business-interruption damages arising out of or relating to these Terms or platform use.

Separate written agreements, including employment documents, handbook provisions, or other written terms provided by Tempo, may contain different rights, obligations, limitations, or remedies for the matters they cover. Nothing in these Terms limits rights or obligations that cannot be limited under applicable law.

10Governing Law, Updates, and Electronic Acceptance

Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Separate written agreements may provide different dispute-resolution, arbitration, venue, or governing-law terms for specific relationships or services.

Updates

Tempo may update these Terms from time to time. Updates will be posted with a new "Last Updated" date. Material changes may be communicated by email, app or portal notice, website notice, or other appropriate means.

Electronic acceptance

By clicking "Submit," "Apply," "Create Account," "I Agree," checking an acceptance box, providing an electronic signature, accessing the app or professional web portal, accepting assignments, or otherwise using the platform, you acknowledge that you have read and understood these Terms, agree to be bound by these Terms, and acknowledge Tempo's Privacy Policy. Electronic acceptance and electronic signatures are intended to have the same force and effect as handwritten signatures.

These Client Terms of Service ("Terms") govern the use of the Tempo Dental Staffing platform and services by dental practices, offices, clinics, and other healthcare facilities ("Client"). By creating an account, requesting staffing services, posting shifts, or using the Tempo Dental Staffing platform, the Client agrees to be bound by these Terms and acknowledges Tempo Dental Staffing's Privacy Policy

1. Agreement to Terms

By registering for an account, posting shifts, requesting staffing services, or otherwise using the Tempo Dental Staffing platform, Client acknowledges that it has read, understood, and agrees to these Terms.

If the individual accepting these Terms is acting on behalf of a business entity, they represent and warrant that they have authority to bind the entity to these Terms.

2. Services

Tempo Dental Staffing ("Tempo") provides a technology platform and staffing services connecting dental practices with qualified professionals including:

  • Registered Dental Hygienists (RDH)
  • Dental Assistants (DA)
  • Registered Dental Assistants (RDA)
  • Front Office Staff
  • Sterilization Technicians
  • Treatment Coordinators
  • Office Managers
  • Dentists
  • Dental Specialists

Tempo may provide workers as W-2 employees, independent contractors where legally permitted, or through other staffing arrangements.

Tempo reserves the right to determine assignments based upon qualifications, experience, availability, and client requirements.

3. Account Registration

Client agrees to:

  • Provide accurate and complete information.
  • Maintain current contact and billing information.
  • Keep login credentials secure.
  • Immediately notify Tempo of unauthorized account access.

Client is responsible for all activity occurring under its account.

4. Shift Requests and Bookings

  • Clients may submit staffing requests through the platform.
  • A staffing request does not guarantee placement.
  • A booking is confirmed only after Tempo confirms assignment.
  • Tempo will use commercially reasonable efforts to fill staffing requests but does not guarantee coverage.

5. Client Responsibilities

Client agrees to:

  • Provide a safe workplace.
  • Comply with applicable federal, state, and local laws.
  • Provide proper equipment and workspace.
  • Communicate duties, schedules, and office procedures.
  • Report incidents, injuries, complaints, and performance concerns immediately.

Client is responsible for supervising professionals while working onsite.

6. Professional Qualifications

Tempo makes reasonable efforts to verify licenses, certifications, credentials, work eligibility, and qualifications.

Client remains responsible for determining whether assigned professionals satisfy its operational requirements.

Client agrees to promptly notify Tempo regarding concerns involving licensing, professionalism, patient safety, or performance.

7. Fees and Payment

Client agrees to pay all staffing fees, placement fees, platform fees, subscription fees, administrative fees, service charges, taxes, and other applicable charges.

  • Rates may appear within the platform or in separate agreements.
  • Payments may be processed automatically.
  • A valid payment method must remain on file.
  • Past due balances may accrue interest to the maximum rate permitted by law.
  • Client is responsible for reasonable collection costs and attorney's fees.

8. Cancellations

Client Cancellations

  • More than 24 hours before shift: No cancellation fee.
  • Less than 24 hours before shift: Up to the full booking amount may be charged.
  • If a professional arrives and the shift is shortened or canceled, Client may be billed for scheduled hours.

Professional Cancellations

Tempo will attempt to provide a replacement but cannot guarantee replacement coverage.

9. Timesheets and Hours Worked

  • Client agrees to verify hours worked through the Tempo platform.
  • Submitted hours not reviewed within the review period may automatically be approved.
  • Billing is based upon actual hours worked unless otherwise agreed.

10. Temporary-to-Permanent Placement and Staffing Program Fees

Tempo invests significant resources recruiting, credentialing, screening, onboarding, and maintaining qualified professionals.

If Client hires, contracts with, or otherwise retains a professional introduced by Tempo within twelve (12) months of the professional's most recent assignment, Tempo may assess a Temporary-to-Permanent Placement Fee.

The Placement Fee may be determined by:

  • A separate staffing agreement.
  • A published fee schedule.
  • A written proposal.
  • Other pricing communicated by Tempo.

Tempo may also offer subscription staffing programs, recurring staffing services, workforce management solutions, memberships, administrative services, or platform services that include recurring monthly fees.

Client agrees not to circumvent Tempo by hiring introduced professionals to avoid placement or subscription fees.

11. Workplace Safety and Injuries

Client shall maintain a safe workplace and comply with OSHA requirements.

Client must immediately notify Tempo regarding:

  • Workplace injuries
  • Patient incidents
  • Safety concerns
  • Harassment claims
  • Discrimination complaints
  • Regulatory investigations

12. Confidentiality

Both parties agree to maintain confidentiality of non-public information including pricing, employee information, patient information, business operations, proprietary processes, and platform data.

Confidentiality obligations survive termination.

13. HIPAA Compliance

Both parties agree to comply with HIPAA and other applicable healthcare privacy laws.

Client shall not improperly disclose Protected Health Information (PHI) through the platform.

14. Platform Use

Client agrees not to:

  • Share login credentials.
  • Attempt unauthorized platform access.
  • Interfere with platform operations.
  • Upload malware or malicious software.
  • Use the platform for unlawful purposes.

Tempo may suspend or terminate accounts for violations.

15. Intellectual Property

All software, trademarks, logos, content, technology, workflows, and intellectual property remain the property of Tempo Dental Staffing or its licensors.

Client receives a limited, non-exclusive, non-transferable license to use the platform.

16. Disclaimer of Warranties

The platform and staffing services are provided "AS IS" and "AS AVAILABLE." Tempo disclaims all express and implied warranties, including uninterrupted service, staffing availability, and error-free operation.

17. Limitation of Liability

To the fullest extent permitted by law, Tempo shall not be liable for indirect, incidental, special, consequential, punitive, or lost-profit damages.

Tempo's total liability shall not exceed the fees paid by Client during the six (6) months preceding the claim.

18. Indemnification

Client agrees to indemnify and hold harmless Tempo from claims arising from:

  • Client's breach of these Terms.
  • Unsafe workplace conditions.
  • Client negligence.
  • Violations of applicable law.
  • Patient claims arising from Client actions.

19. Termination

Either party may terminate services at any time.

Termination does not relieve Client of payment obligations for services already rendered.

Payment, confidentiality, indemnification, limitation of liability, and dispute resolution provisions survive termination.

20. Governing Law

These Terms shall be governed by the laws of the State of Texas without regard to conflict of law principles.

21. Changes to Terms

Tempo may modify these Terms from time to time. Updated Terms become effective when posted. Continued use of the platform constitutes acceptance of revised Terms.

22. Electronic Acceptance

By selecting "I Agree," checking the acceptance box, creating an account, accessing the platform, posting shifts, requesting staffing services, or otherwise using the Tempo platform, Client agrees to be legally bound by these Terms and acknowledges Tempo Dental Staffing's Privacy Policy

Electronic acceptance has the same legal effect as a handwritten signature.

If accepted on behalf of a company or organization, the accepting individual represents and warrants they have authority to bind the entity.
