WHAT PERSONAL INFORMATION DOES Tempo Dental Staffing COLLECT?
We collect the following types of information from our users: Personal Information You Provide to Us: We may receive and store any information you submit to the Application (or otherwise authorize us to obtain – such as, from (for example) your Facebook account). The types of personal information collected may include your full name, email address, gender, IP address, browser information, username, demographic information, and any other information necessary for us to provide the Application services. Personal Information Collected Automatically: We receive and store certain types of usage related information whenever you interact with Application. For example, Tempo Dental Staffing may automatically receive and record information regarding your computer’s IP address, browser information, Facebook user ID, Facebook Page fan status, and URLs accessed. Such information may be shared in aggregate (non-personally identifiable) form with our partners.
HOW DOES Tempo Dental Staffing USE THE INFORMATION IT COLLECTS?
Tempo Dental Staffing uses the information described in this Privacy Statement (i) internally, to analyze, develop and improve its products and services, and (ii) as set forth below in the “Will Tempo Dental Staffing Share any of the personal information it Collects” section below.
APPLICATION PARTNER TREATMENT OF PERSONAL INFORMATION.
Tempo Dental Staffing may provide personal information to the applicable Application Partner. The Application Partner’s use of your personal information is subject to the Application Partner’s separate privacy policy – and not this Privacy Statement. The Application Partner’s privacy policy is linked to from within the Partner’s Facebook application.
WILL Tempo Dental Staffing SHARE ANY OF THE PERSONAL INFORMATION IT RECEIVES?
Personal information about our users is an integral part of our business. We neither rent nor sell your personal information to anyone (with the exception of sharing your information with an applicable Application Partner – see the “Application Partner Treatment” section above). We share your personal information only as described below. Application Partners: We will share your personal information with an applicable Application Partner (see the “Application Partner Treatment” section above). Agents: We employ other companies and people to perform tasks on our behalf and need to share your information with them to provide products or services to you. Unless we tell you differently, Tempo Dental Staffing’s agents do not have any right to use personal information we share with them beyond what is necessary to assist us. You hereby consent to our sharing of personal information for the above purposes. Business Transfers: In some cases, we may choose to buy or sell assets. In these types of transactions, customer information is typically one of the business assets that are transferred. Moreover, if Tempo Dental Staffing, or substantially all of its assets were acquired, or in the unlikely event that Tempo Dental Staffing goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of Tempo Dental Staffing may continue to use your personal information as set forth in this policy. Such third party applications/websites are not under Tempo Dental Staffing’s control, and such links do not constitute an endorsement by Tempo Dental Staffing of those other applications/websites or the services offered through them. The privacy and security practices of such third party application/websites linked to the Application are not covered by this Privacy Statement, and Tempo Dental Staffing is not responsible for the privacy or security practices or the content of such websites.

CAN CHILDREN USE THE APPLICATION?
Our site and the services available through Tempo Dental Staffing are not intended for children under the age of 13. Tempo Dental Staffing does not knowingly or specifically collect information about children under the age of 13 and believes that children of any age should get their parents’ consent before giving out any personal information. We encourage you to participate in your child’s web experience.
CHANGES TO THIS PRIVACY STATEMENT.
Tempo Dental Staffing may amend this Privacy Statement from time to time. Use of information we collect now is subject to the Privacy Statement in effect at the time such information is used. One Wolf Inc. ("Wolf") provides a proprietary electronic platform for on-demand staffing and workforce management and related products and services to its clients (each a, "Client"). This Privacy Policy describes how your personal information is collected, used, shared and safeguarded when you access Wolf's mobile applications, websites, services or products (collectively, the "Platform"). Any personal information that you provide to a Client via the Platform is collected on behalf of and for the sole benefit of the applicable Client(s) and is subject to their privacy and security practices and policies. Wolf does not process or disclose your personal information for any purpose other than to provide its services to Clients.

Please read this Privacy Policy carefully. By using the Platform, you consent to the collection and use of your personal information by us as set out in this Privacy Policy. IF YOU DO NOT AGREE WITH THE TERMS OF THIS PRIVACY POLICY, YOU ARE NOT PERMITTED TO USE OR ACCESS THE PLATFORM

PERSONAL INFORMATION WE COLLECT

When you interact with the Platform, we may automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you use the Platform, we may collect information about the individual web pages that you view, what websites or search terms referred you to the Platform, and information about how you interact with the Platform. We refer to this automatically collected information as "Device Information."

Additionally, we may collect certain personal information that you provide to us or Client(s) via the Platform from time to time, such as your name or email address.

You are under no obligation to provide us with personal information of any kind, however your refusal to do so may prevent you from using certain features of the Platform.

HOW DO WE USE YOUR PERSONAL INFORMATION?

We and our service providers use personal information for our legitimate business purposes, including those specifically described below. We engage in these activities to manage our contractual relationship with you, to comply with a legal obligation and/or because we have a legitimate business interest.

We use the personal information that we collect generally to fulfill any requests made through the Platform. Additionally, we use personal information to communicate with you, personalize your experience on the Platform, and, when in line with the preferences you have shared with us, provide you with information or advertising relating to Wolf and/or Client(s), which may include their products or services.

We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize the Platform (for example, by generating analytics about how our users browse and interact with the Platform.

SHARING YOUR PERSONAL INFORMATION

We may share your personal information with third parties to help us use your personal information to provide the Platform, as described above. We may share your personal information with our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates may include a parent company and any subsidiaries, joint venture partners or other companies that we control or that are under common control with us. We may share your personal information with advisors and actual and potential investors for the purpose of conducting general business analysis. If we reorganize or sell all or a portion of our assets, undergo a merger or are acquired by another entity, we may transfer your personal information to the successor entity. If we go out of business or enter bankruptcy, your personal information would be an asset transferred or acquired by a third party. You acknowledge that such transfers may occur and that the transferee may decline to honor commitments we made in this Privacy Policy. Finally, we may also share your personal information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

Text Messaging Compliance: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories of data sharing exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

DO NOT TRACK

Most web browsers and some mobile operating systems include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will revise this Privacy Policy accordingly.

JURISDICTION AND CROSS-BORDER TRANSFER

Your personal information may be stored and processed in any country where we have facilities or in which we engage service providers, and by using the Platform you consent to the transfer of information to countries outside of your country of residence, including the United States, which may have data protection rules that are different from those of your country. In certain circumstances, courts, law enforcement agencies, regulatory agencies or security authorities in those other countries may be entitled to access your personal information.

RIGHTS AND OPTIONS REGARDING YOUR PERSONAL INFORMATION

If you request deletion of your personal information, we will delete your personal information from our active databases following receipt of your verified request; provided, however, that some information may be retained in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our terms of use, and/or comply with legal requirements, and, when we are processing your personal information as a service provider on behalf of a Client, we may submit your request to the Client and follow its lawful instructions with respect to your request.

EMAILS AND OTHER COMMUNICATIONS

If you no longer wish to receive communications (including, without limitation, email and SMS/MMS messages) from us, you may opt-out by emailing us at privacy@fromwolf.com. If you no longer wish to receive communications (including, without limitation, email and SMS/MMS messages) from a third party (including Client(s)), you are responsible for contacting the third party directly.

DATA RETENTION

We will retain your personal information for as long as needed or permitted in light of the purpose(s) for which it was obtained. The criteria used to determine our retention periods include the length of time we have an ongoing relationship with you, when we have a legal obligation to which we are subject, or as advisable in light of legal requirements.

THIRD PARTY WEBSITES

The Platform may contain links to third party websites and applications of interest that are not affiliated with us. Once you have used these links to leave the Platform, any information you provide to these third parties is not covered by this Privacy Policy, and we cannot protect the safety and privacy of information that you provide to a third party outside of the Platform. Before visiting and providing any information to any third party websites or applications, you should inform yourself of the privacy policies and practices (if any) of the third party responsible for that website or application, and should take those steps necessary to, in your discretion, protect the privacy of your personal information. We are not responsible for the content or privacy and security practices and policies of any third parties (including Client(s)), including other sites, services or applications that may be linked to or from the Platform.

SECURITY OF YOUR PERSONAL INFORMATION

We use administrative, technical and physical security measures to help protect your personal information. While we have taken reasonable steps to secure the personal information you provide to us, please be aware that despite our efforts no security measures are perfect or impenetrable and no method of data transmission can be guaranteed against any interception or other type of misuse. Any information disclosed online is vulnerable to interception and misuse by unauthorized parties. Therefore, we cannot guarantee complete security if you provide personal information to us.

CHANGES

We reserve the right to make changes to this Privacy Policy at any time and for any reason. We will alert you about any changes by updating the "Last Revised" date at the top of this Privacy Policy. Any changes or modifications will be effective immediately upon posting the updated Privacy Policy on the Platform, and you waive the right to receive specific notice of each such change or modification. As a "service provider", Wolf processes your personal information in order to provide its services to the Client(s), and in order to facilitate your interactions with the Client(s). To learn more about rights that you may have under the CCPA, such as the right to request information about the types of your personal information that has been collected, the right to request that your personal information be deleted, and the right to opt-out of the sale of your personal information, please contact the applicable Client(s).

Wolf and the Platform comply with the CCPA and other applicable laws. If you'd like to make a request to Wolf regarding your personal information, please contact us by e-mail at privacy@fromwolf.com, and we will try to accommodate your request unless we are prevented from doing so as a result of applicable law or a significant legitimate interest of Wolf. By submitting an employment application through this website, portal, or related electronic system, you represent and warrant that:

  • The information you provide is true, accurate, current, and complete to the best of your knowledge.

You authorize Tempo Dental Staffing and its representatives to review, process, verify, and retain your application materials for recruitment, hiring, credentialing, onboarding, compliance, recordkeeping, client placement, and related business purposes, subject to applicable law and the company's Privacy Policy.

You understand that any offer of employment, temporary assignment, contract assignment, or placement opportunity will be subject to additional terms, conditions, verifications, reference checks, credential reviews, background checks, drug testing requirements (where permitted by law), and eligibility requirements determined by Tempo Dental Staffing or its clients.

You agree that Tempo Dental Staffing may communicate with you electronically regarding your application, assignments, scheduling opportunities, credentialing requirements, onboarding documents, employment matters, and other staffing-related communications by email, text message (SMS), telephone call, voicemail, push notification, or through an applicant portal, to the extent permitted by law.

You are responsible for maintaining accurate and current contact information and for monitoring your email account, phone, text messages, and applicant portal for communications related to your application and employment opportunities.

You acknowledge that Tempo Dental Staffing may reject, remove, or disregard any application that is incomplete, inaccurate, misleading, duplicative, submitted through unauthorized means, or otherwise not in compliance with these terms or applicable law.

Any intentional misrepresentation, omission of material information, falsification of credentials, submission of false or misleading documents, or failure to disclose required information may result in disqualification from consideration, withdrawal of any offer, removal from assignments, or termination of employment if discovered after hire, to the extent permitted by law.

You acknowledge that Tempo Dental Staffing may share your application information, credentials, resume, work history, availability, professional qualifications, and related employment information with prospective client facilities for the purpose of evaluating and securing employment opportunities.

To the extent permitted by applicable law, all application materials submitted to Tempo Dental Staffing become part of the company's recruitment and employment records and will not be returned. You should not submit confidential, proprietary, or sensitive information that is not specifically requested as part of the application process.

Nothing contained in this application process shall be construed as creating an employment contract. If hired, employment will generally be at-will unless otherwise provided by applicable law or a separate written agreement signed by an authorized representative of Tempo Dental Staffing.

Tempo Dental Staffing – Client Terms of Service

These Client Terms of Service ("Terms") govern the use of the Tempo Dental Staffing platform and services by dental practices, offices, clinics, and other healthcare facilities ("Client"). By creating an account, requesting staffing services, posting shifts, or using the Tempo Dental Staffing platform, the Client agrees to be bound by these Terms.

1. Agreement to Terms

By registering for an account, posting shifts, requesting staffing services, or otherwise using the Tempo Dental Staffing platform, Client acknowledges that it has read, understood, and agrees to these Terms.

If the individual accepting these Terms is acting on behalf of a business entity, they represent and warrant that they have authority to bind the entity to these Terms.

2. Services

Tempo Dental Staffing ("Tempo") provides a technology platform and staffing services that connect dental practices with qualified dental professionals, including but not limited to:

  • Registered Dental Hygienists (RDH)
  • Dental Assistants (DA)
  • Registered Dental Assistants (RDA)
  • Front Office Staff
  • Sterilization Technicians
  • Treatment Coordinators
  • Office Managers
  • Dentists
  • Dental Specialists

Tempo may provide workers as W-2 employees, independent contractors where legally permitted, or through other staffing arrangements.

Tempo reserves the right to determine worker assignments based on qualifications, availability, experience, and client requirements.

3. Account Registration

Client agrees to:

  • Provide accurate and complete information.
  • Maintain current contact and billing information.
  • Keep login credentials secure.
  • Notify Tempo immediately of unauthorized account access.

Client is responsible for all activity occurring under its account.

4. Shift Requests and Bookings

Clients may submit staffing requests through the platform.

A staffing request does not guarantee placement.

A booking is confirmed only after Tempo confirms assignment of a professional.

Tempo will make commercially reasonable efforts to fill requested shifts but does not guarantee coverage of every request.

5. Client Responsibilities

Client agrees to:

  • Provide a safe working environment.
  • Comply with all applicable federal, state, and local laws.
  • Provide appropriate equipment, supplies, and workspace.
  • Communicate job duties, schedules, and office procedures.
  • Immediately report any workplace incidents, injuries, complaints, or performance concerns.

Client is responsible for supervising professionals while they are working onsite.

6. Professional Qualifications

Tempo makes reasonable efforts to verify professional qualifications, licenses, certifications, and work eligibility.

However, Client remains responsible for determining whether an assigned professional meets the Client's specific operational needs.

Client agrees to promptly notify Tempo of any concerns regarding performance, licensing, professionalism, or patient safety.

7. Fees and Payment

Client agrees to pay all applicable staffing fees, platform fees, monthly service fees, placement fees, service charges, and taxes associated with services provided by Tempo.

Rates and fees may be displayed within the platform, outlined in a separate service agreement, or otherwise communicated prior to service.

Payments may be processed automatically using the payment method on file.

Failure to maintain a valid payment method may result in suspension or termination of services.

Past due balances may be subject to interest at the maximum rate permitted by law. Client shall be responsible for reasonable collection costs, attorneys' fees, and expenses incurred in collecting unpaid balances.

8. Cancellations

Client Cancellations

  • More than 24 hours before shift start: No cancellation fee.
  • Less than 24 hours before shift start: Client may be charged up to the full shift booking amount.
  • If a professional arrives and the shift is canceled or shortened, Client may be charged for scheduled hours.

Professional Cancellations

If a professional cancels, Tempo will attempt to provide a replacement but cannot guarantee replacement coverage.

9. Timesheets and Hours Worked

Client agrees to verify hours worked through the Tempo platform.

If Client fails to review submitted hours within the designated review period, submitted hours may be automatically approved for billing purposes.

Billing is based on actual hours worked unless otherwise specified.

10. Temporary-to-Permanent Placement and Staffing Program Fees

Tempo invests significant resources in recruiting, screening, credentialing, onboarding, and maintaining qualified dental professionals.

If Client hires, engages, contracts with, employs, or otherwise retains a professional introduced by Tempo, whether directly or indirectly, within twelve (12) months of the professional's most recent assignment through Tempo, Tempo may assess a Temporary-to-Permanent Placement Fee.

The amount of the Placement Fee may be determined by:

  • A separate staffing agreement;
  • A fee schedule published by Tempo;
  • A written proposal;
  • Or other pricing communicated by Tempo.

In addition, Tempo may offer recurring staffing programs, subscription services, managed staffing solutions, workforce management services, or staffing memberships that include monthly staffing fees, platform fees, administrative fees, or service fees.

By using such services, Client agrees to pay any applicable recurring fees associated with those programs.

Client agrees not to circumvent Tempo by hiring, engaging, or contracting with Tempo-introduced professionals for the purpose of avoiding placement fees, staffing fees, subscription fees, or other charges owed to Tempo.

11. Workplace Safety and Injuries

Client shall maintain a safe workplace and comply with OSHA and applicable workplace safety requirements.

Client must immediately notify Tempo of:

  • Workplace injuries
  • Patient incidents
  • Safety concerns
  • Harassment claims
  • Discrimination complaints
  • Regulatory investigations

12. Confidentiality

Each party agrees to maintain the confidentiality of non-public information received from the other party.

Confidential information includes business information, pricing, patient information, employee information, platform data, and proprietary processes.

Confidentiality obligations survive termination of these Terms.

13. HIPAA Compliance

Both parties agree to comply with applicable healthcare privacy laws, including HIPAA where applicable.

Client shall not use the platform to improperly disclose protected health information (PHI).

14. Platform Use

Client agrees not to:

  • Share account credentials.
  • Attempt unauthorized access to the platform.
  • Interfere with platform operations.
  • Upload malicious software.
  • Use the platform for unlawful purposes.

Tempo may suspend or terminate accounts for violations of these Terms.

15. Intellectual Property

All platform software, trademarks, logos, content, workflows, and technology are owned by Tempo Dental Staffing or its licensors.

Client receives a limited, non-exclusive, non-transferable right to use the platform during the term of these Terms.

No ownership rights are transferred.

16. Disclaimer of Warranties

The platform and staffing services are provided on an "as-is" and "as-available" basis.

Tempo makes no warranties, express or implied, regarding platform availability, staffing availability, specific staffing outcomes, uninterrupted service, or error-free operation.

17. Limitation of Liability

To the maximum extent permitted by law, Tempo Dental Staffing shall not be liable for indirect, consequential, incidental, special, punitive, or lost-profit damages.

Tempo's total liability under these Terms shall not exceed the total fees paid by Client to Tempo during the six (6) months preceding the claim.

18. Indemnification

Client agrees to indemnify, defend, and hold harmless Tempo Dental Staffing and its affiliates, officers, employees, and agents from claims arising out of:

  • Client's breach of these Terms
  • Workplace conditions
  • Client negligence
  • Client's violation of law
  • Patient claims arising from Client actions

19. Termination

Either party may terminate services at any time.

Termination does not relieve Client of payment obligations for services rendered prior to termination.

Sections relating to payment, confidentiality, indemnification, limitation of liability, and dispute resolution survive termination.

20. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles.

21. Changes to Terms

Tempo may update these Terms from time to time.

Updated Terms will be posted within the platform.

Continued use of the platform after changes become effective constitutes acceptance of the revised Terms.

22. Electronic Acceptance

By selecting "I Agree," checking the acceptance box, creating an account, accessing the platform, posting shifts, requesting staffing services, or otherwise using the Tempo Dental Staffing platform, Client acknowledges that it has read, understood, and agrees to be legally bound by these Terms of Service.

The Client further agrees that electronic acceptance of these Terms constitutes a legally binding agreement and has the same force and effect as a handwritten signature.
